Lawyer for the embattled former National Signals Bureau boss, Kwabena Adu Boahen, has questioned the Attorney General’s decision to drop charges against Mildred Donkor, a key accused person in the ongoing GH¢49 million theft case, according to a citinewsroom.com report.
According to lead counsel Samuel Atta Akyea, he cannot fathom why the Attorney General, after accusing the third accused of being involved in money laundering with her alleged partners, would have her charges dropped, only for her to suddenly become a witness in the same case.
He described the move by the Attorney General’s office as a “dramatic development” that undermines the integrity of the prosecution.
Speaking to the media on Friday, October 17, Atta Akyea said, “For the first time, I am hearing that somebody has been withdrawn as an accused person is being made a witness. I can tell you that it is one of the most interesting and dramatic developments in this whole matter because an accused person has now become a prosecution witness.”
He further questioned the Attorney General’s inconsistency, saying, “The AG has published to the whole world that the third accused is involved in money laundering activities with the first and second accused. So, what has changed?
“Guess who signed it? The AG himself signed it before the court and the charge sheet says so. So, what has changed for the AG to make such a huge somersault that the person he accused of money laundering should now come and testify against the very people she was charged with?”
Atta Akyea expressed concern that the prosecution was acting in “indecent haste” to strengthen its case by turning a former accused into a state witness, despite having publicly implicated her.
“It is too early to talk about it but for me, it leaves much to be desired,” he added.
Meanwhile, Mildred Donkor, who was previously the third accused in the high-profile case involving Adu Boahen, his wife Angela Adjei-Boateng, and their company, Advantage Solutions Ltd, was formally discharged by the High Court after the Attorney General filed a notice of withdrawal.
She is now expected to testify as a prosecution witness.
