
Entire Supreme Court justices will be sacked in 2029 – Andrew Kofi Egyapa Mercer
The immediate past Minister of Tourism, Arts and Culture, Andrew Kofi Egyapa Mercer, has given strong indications that a future government under the New Patriotic Party will sack the entire justices at the Supreme Court.
Due to this intention, Mercer, a lawyer with over twenty years of experience, disclosed that the current bench of the Apex Court has become coterminous with the tenure of the current government.
Speaking on the Badwam Programme on Adom TV, the former member of parliament for Sekondi on the ticket of the NPP, alleged that this intended action has been necessitated by the current government’s decision to remove Gertrude Torkornoo as the Chief Justice.
Explaining further, he alleged that the processes leading to the removal of the former Chief Justice Gertrude Torkornoo were “shambolic” and part of the NDC’s long-held intention to sack the CJ.
He said, “When these shambolic petitions started, when the Council of State issued its opinion, when the president proceeded to suspend the Chief Justice, we spoke about it, but they were bent on doing it.”
He remarked that “I am waiting for 2029 if God grants victory to the NPP and we come to power, not only the Chief Justice but all of them. Per the actions of Mr Mahama and his government, we have been told that the Supreme Court bench is coterminous with the office of the President.”
On Monday, September 1, 2025, President John Dramani Mahama, in accordance with Article 146(9) of the 1992 Constitution, removed the Chief Justice, Her Ladyship Justice Gertrude Araba Esaaba Sackey Torkornoo, from office with immediate effect.
The President’s action followed receipt of the report of the Committee constituted under Article 146(6) to inquire into a petition submitted by a Ghanaian citizen, Daniel Ofori.
Her sack was contained in a statement issued by the Minister of State in charge of government communications and spokesperson to the President, Felix Kwakye Ofosu.
“After considering the petition and the evidence, the Committee found that the grounds of stated misbehaviour under Article 146(1) had been established and recommended her removal from office,” Kwakye Ofosu’s statement read.
Under Article 146(9), the President is required to act in accordance with the Committee’s recommendation.
She was suspended on April 22, 2025, and a five-member committee was set up to investigate petitions against her.
The Committee, led by Justice Gabriel Pwamang, found grounds of stated misbehaviour, leading to her dismissal.
